
What About Legal Fees?
Can I collect attorney's fees as part of my damages?
Generally, attorney's fees are recoverable in a lawsuit only by statute or contract. There is no statute which awards attorney's fees in a legal malpractice lawsuit. Any fee agreement with a lawyer must be examined to determine if fees can be awarded.
What fee arrangements are available for my lawsuit?
There is no "typical" fee arrangement for a legal malpractice lawsuit. The options include paying the lawyer by the hour, on a contingency fee basis in which the attorney would be paid a percentage of the monies obtained, paying a certain amount of money at the beginning of the lawsuit with the lawyer being paid a reduced contingency at the end of the lawsuit or combinations of these arrangements.
